Quotation Terms & Conditions

• Prices quoted subject to increases in fuel surcharges and significant changes in supply chain costs.
• Delivery dates quoted are our best estimate and may change due to raw material and transportation availability.
• Unloading and demurrage charges are the customer’s responsibility unless otherwise specified on this quotation.
• Allowances or claim for defect, variance in quality, or for shortages, will only be considered if the Wallace is advised in writing within 18 hours of receipt of the goods.
• This quotation is subject to any increase in freight rate, municipal, provincial and/or federal taxes, sales taxes or tariff rates.
• Wallace Construction Specialties Ltd. (Wallace) shall not be responsible for default in performance and/or delivery due to delay in manufacture and shipment, fire, riot or strikes, Acts of God, or the Queen’s enemies Acts of Governments, force majeure, or any cause whatsoever beyond its control.
• The buyer is familiar with the nature and use of the products acknowledged herein and assumes all liability resulting from, or in any way connected with their possession, handling, or use thereof.
• The buyer will be responsible for obtaining approval for the use of the product from any appropriate agency of government or approval authority.
• There is no representation, warranty or guarantee are on the quoted products other than those of the manufacturer of said product.
• Any loss or damage sustained by buyer because of acceptance of goods supplied by Wallace shall be limited to an amount not exceeding Wallace’s invoiced price for such goods if they are proven to be defective. No claim for consequential or liquidated damages will be recognized.
• Each delivery shall be considered a separate contract and proven defective deliveries in respect of one or more installments shall not vitiate the contract as to others.
• Should the buyer neglect or refuse to take delivery or pay for one or more shipments or should they become bankrupt or insolvent Wallace may at their option cancel delivery of further materials or products.
• Wallace reserves the right to attach its imprint on all goods unless explicitly advised otherwise.
• This quotation is conditional upon satisfactory payment arrangements having been made prior to shipment.
• A service charge of 2% monthly is applicable on all accounts not paid in accordance with terms arranged.
• The prices quoted are based on payment in full within 30 days of the date of the invoice.
• No holdback under lien legislation is allowed for in this quote.
• Return of reasonable quantities of stock goods subject to 15% restocking. Prior approval of return of goods must be arranged. Special order goods may not be returned.
• The buyer warrants that they are not a “consumer” within the meaning of the Consumer Product Warranties Act and the goods purchased against this quotation are not “consumer products” within the meaning of the Act.
• Rental quotations are subject to special Terms and Conditions.
