Sale Terms & Conditions
- On approved credit. Terms of sale are net 30 days. A service charge of 2% per month (24% per annum) is applicable on all balances not paid. These service charges form part of our credit terms of sale.
- Standard merchandise returned subject to 15% reduction for handling plus freight charges. Merchandise returnable only with prior written approval and on conditions laid down by the Vendor.
- Unloading and demurrage charges are the customer's responsibility.
- Allowances or claim for defect, variance in quality, or for shortages will only be considered if Wallace is advised in writing within 18 hours of receipt of goods.
- All claims must be filed within 10 days of receipt of goods.
- Deferment of delivery or changes in specifications can only take place by special arrangement with seller, and in the case of changes in specifications, these cannot be made in any case after goods have entered production.
- Seller shall not be liable because of late or non-delivery due to strike or labour unrest, fire, inability to secure raw materials, manufacture delay, transportation shortages, force majeure or any other causes beyond seller's control.
- Any loss or damage sustained by buyer because of acceptance of use of goods supplied by seller shall be limited to an amount not exceeding seller's invoiced price for such goods. No claim involving consequential damages will be recognized.
- The buyer is familiar with the nature and use of the products acknowledged herein and assumes all liability resulting from, or in any way connected with their possession, handling or use thereof.
- The buyer will be responsible for obtaining approval of the use of the product from any appropriate agency of government or approval authority.
- No representation, warranty or guarantee are on this order other than those of manufacture of said product.
- Each delivery shall be considered a separate contract and defective deliveries in respect of one or more installments shall not vitate the contract as to the others.
- Should the buyer neglect or refuse to take delivery of or pay for one or more shipments or should they become bankrupt or insolvent the seller may at their option cancel delivery of further materials or products.
- The seller reserves the right to attach its imprint to all goods unless particularly advised otherwise.
- The buyer warrants that he is not "a consumer" within the meaning of the Consumers Product Warranties Act and the goods purchased on this invoice are not "consumer products" within the meaning of the Act.
- Rental quotations are subject to special terms and conditions.
